- Reporting in Family Law and Childcare Cases – the In Camera Rule
Notably one of the most significant practical changes to family law practice, the changes that came into force now allow the media to report on family law and childcare proceedings, according to strict conditions. These reforms are designed to address the need for public access to important information on the operation of family and child care proceedings in the courts and provide valuable information to practitioners also. Most critically the reporting permission is balanced at all times with the family’s right to privacy and the overriding need to protect the identity of children.
- The Children and Family Relationships Bill
While not yet finalised this is a remarkable piece of legislation which will bring long awaited reform to the Family Law area. It covers a broad spectrum of changes which recognise the changing face of family structures in Ireland, addressing : Guardianship of Children, Adoption, Surrogacy and Reproductive Rights
- Proposals for the New Family Court Structure
Under Alan Shatters watch, the process has commenced to overhaul the countrywide structure of the Family Courts, to provide for a specialised Family Court, with consideration being given to specialised and dedicated Family Law Judges. This remains one to monitor closely under the stewardship of Minister Fitzgerald, whose keen consideration of children, must surely see the Voice of the Child incorporated effectively into this new Court.
- Referendum for Same-Sex Marriage
Again the promised holding of a Referendum to allow and Same Sex Marriage, is a further additional step in the recognition of our advanced society and the changing face of family structures and relationships.
- The Personal Insolvency Act
Although this wouldn’t be considered a piece of Family law Legislation, the Act has key implications for those going through Separation or Divorce proceedings, and in many cases, provides an option to a separating couple to extricate themselves from joint bank debt which effectively prevents them achieving a much needed clean break.
